farnz Posted October 10, 2009 Share #83 Posted October 10, 2009 Bill, Thanks for clarifying the position on model releases but at the risk of incurring your wrath so as to save you some potential grief later are you certain that in the unlikely case of a writ being issued the defendant would be the photographer and not the editor who is responsible for actually publishing the offending photo? If you're not certain then leaving the responsibility for the model release up to the photographer (although in itself a perfectly reasonable thing to do) may not protect you from prosecution. Re Pete's comment above, I think we need to remember that before you get to any sort of legal situation, the subject would need to see the photo/book and take exception to it (as opposed to perhaps being flattered?! - depending on the image of course). They would then need to seek legal advice to clarify their position, instigate legal action at considerable cost to themselves and for what ends? Bill is wise to satisfy himself with the legal position of course, but also consider what is likely in reality - whilst this sounds like an excellent project I doubt if it will sell many copies beyond the participants and other forum members. After all, posting an image on this forum is just the same as publishing it in a book. In explanation: I would far rather suffer the ignominy of being accused of being alarmist and for my concern to be groundless than to have said nothing and for anyone associated with the book to find themselves unwittingly targetted by these aggressively litigative piranhas.
