Well yes but when I first got my M9 (one of the very early ones when they weren't available in any number) it had a problem with the paint finish and a new one get sent over from Germany the next day. I'm sure you should be able to get a replacement if you push the point you also maybe entitled to it under selling regulations in the country you live in

maybe you could contact leica directly I have always found them very helpful. Personally I wouldn't be happy with having to send a brand new camera back for repair especially if this is a fault straight out the box. it would also seem to point to a quality control issue.

it should have been checked already...at least the signature coming in the box says so...must have been asleep that poor fella...

guess i will call leica in the morning and let them tell me what to do...

I would send it back, I prefer one that has been thoroughly checked by Customer Service.

Top quality German product should have already been thoroughly checked by quality control!! Of course things can go wrong even on a new product but I feel he should be offered a replacement without having to think that the only way to get it checked properly is having to send the defective unit back

I would not run the risk of sending a faulty new camera in Germany or anywhere else personally. It would be carried and handled at your own risks if you did that. Leicashop are responsible, legally speaking, so the only thing to do is to return them the camera and let them decide to repair or replace it at their own risks and expense under warranty. Ugly lawyer speaking. ;)

If you send it insured it will be covered. Or, if Leica arranges the pickup by UPS I don't see a problem either. However using Leicashop is fine; they have an excellent reputation.

@Dasjak: I had a look at your website. Fine work that I can relate to, thanks.

Sending insured or getting Leica to arrange a pickup cannot change the fact that the contract has been concluded between two parties, the customer and the dealer. There is indeed a good chance that Leica accepts liability in case of transportation or transit damage for instance but there is no legal warranty of that.
