jlm Posted November 17, 2006 Share #61 Posted November 17, 2006 Advertisement (gone after registration) I was told by one dealer that the credit card company charges them 3% per transaction, so if you made a $1,000 deposit by credit card and it was credited back to you upon cancelling, that would cost the dealer $60 plus his time and effort. you think he should eat that and have no sale? I'm pretty sure refunds are not charged.
harmsr Posted November 17, 2006 Share #63 Posted November 17, 2006 John, Actually James is correct. The credit card company gets 3% or whatever the percentage is in your merchants services contract of any transaction whether it be a credit or debit. palaeoboy Posted November 17, 2006 Share #64 Posted November 17, 2006 I personally dont think they have a leg to stand on. Firstly they did offer a refund of your deposit and retracted it and also you are cancelling on a known faulty product. Any consumer protection agency would probably be more surprised if you actually accepted the camera knowing it was faulty. You could also adopt the course of action to tell them fine my deposit stands as long as they provide the camera you originally specified. With no IR or other problems. I dont believe any dealer could refuse refunds on a camera that is not as described. Here in Australia we have consumer oganisations that protect buyers with no real need to go through courts. Im certain cancelling a camera before it arrived because it has known issues would qualify as reasonable grounds for a refund of deposit.

The camera is NOT in hand as yet, so you can't say it is faulty. Take posession of the camera, if it doesn't work, THEN you can return it for a refund. "Firstly they did offer a refund of your deposit and retracted it" Verbal agreements or verbal changes to a written agreement are useless. He didn't get, on paper, a statement from the camera store, so he has NOTHING.

sungod Posted November 17, 2006 Share #67 Posted November 17, 2006 Advertisement (gone after registration) Alex, your rights vary depending on how you paid the deposit, i suggest you look at the advice on the trading standards website... Trading Standards Central - Trading Standards and Consumer Protection information for the UK if you need more info, then call the trading standards office, report the problem (to get the retailer on their file, assuming they're not already on it) and ask for advice, they tend to be very helpful i've had my own bad experiences with classic camera, i don't shop there any more
