alexr Posted November 16, 2006 Share #1 Posted November 16, 2006 Advertisement (gone after registration) I called today Classic Camera, my usual Leica dealer in London, to cancel my M8 order. At first they responded by saying no problem, your credit card will be refunded for the 10% deposit you paid when you made the order. After a few minutes, they called me to tell me that Leica would make an official statement on monday, where they would announce that all problems are fixed. They urged me to reconsider my cancellation. I thought about it for a while, then called them back to confirm that I wanted the order cancelled. At this point, they told me that it would mean the loss of my deposit. Exactly the opposite of what they had said a few minutes before. I would like to hear from members who have had similar experiences. Needless to say, i am now talking to my solicitor. Thank-you Link to post Share on other sites More sharing options...

At least here in Germany - after having made a contract with a dealer - You have to give him twice the opportunity to correct the fawlty item. Then You may cancel the contract. As I guess Your deposit is a "contract" and so... Hope that it comes out good for You. I talked to a big dealer here in Germany and he told me never to order an item that's less than half a year old. It seems I am in a fortunate position that my dealer here (Germany) never asks for any downpayment on any item I order , including M8. The law is a very blunt instrument and very expensive. It is not about whether you are right or wrong. With a credit card you can always deny the charge with the bank servicing that card. Dispute the charge with your bank immediately! (Not unlike the standard PayPal protection for purchases under US$1000 on eBay.) You are not trying to cheat this merchant: the product is not as was first discribed to you by the manufacturer. Your bank should agree with you. I would say your one comment has just cost this London dealer more business than they ever dreamt of losing when they savaged you. If you used a credit card just file a complaint ... In addition if you need to buy filters to have the camera functional, the item you purchased initially has been misrepresented. DaveEP Posted November 16, 2006 Share #12 Posted November 16, 2006 I was in there a few days ago, and all the guy could do is brag how many more M8s Leica UK would be shipping him than any other dealer in the country, and how I should give him my 10% deposit now, because regardless of how long other dealers lists were, he would be able to supply me quicker. I didn't care for his attitude, and left without putting a desposit down. I have deposits at other locations, and in each case they told me it was fully refundable..... If you haven't yet paid, they will hold that amount due, and if you have, they might even credit the amount pending the dispute being resolved. Your dealer may ask you to reconsider your cancellation, but at the end he should respect your decision and give you back your deposit. He should also be able to sell your M8 to another customer on the list. I'm wondering, how long are the waiting lists for customers who want to order an M8 at the moment ? So that the M8 works perfectly without using of filters, than your dealer is right and he can keep the money.
