Well that's a different discussion. My reference to the screenshot was as a way of getting past the right click protection mechanism that some websites use - you can no longer right click on an image and choose 'Save as...', instead you have to make a screenshot if you want a copy of the photo. If you are going to make a screenshot of your own work on someone else's website, then it is important to make sure that it includes both the full web address of the site, and, if possible, the date and time. Your next step would be to send them a take down notice, and, if you desire, a bill for usage. I have used the following text in the past, not sure what the original origin of it is though. If you search online you will find various versions of it, including requesting they just attribute the image to you or take it offline, rather than pay an invoice: "It has come to my attention that one of my copyright protected photos has been used as part of your online presence without seeking prior authorization, without proper compensation, and without attribution. This is a violation of national and international copyright laws. The image in question is visible in the attached screen capture of your web site, captured today. The location (URL) of the original image at the date of this email is: http://xxxxx The image is copyright protected. I am the rightful creator and owner of the image. In order to avoid legal troubles for both parties, I offer hereby the following out-of-court settlement: 1. You will properly license this image for the current use at the price of 1000 Ex BTW Euros, which includes a fee to compensate for not seeking proper authorization prior to use. 2. An invoice has been attached with the details 3. In order for the settlement to become valid, the payment has to be made prior to xxx date If you have not paid by that time, I will hand over the case to my IP lawyer to take the necessary steps. 4. This out-of-court settlement is only valid until (date x days from now) under the afore mentioned conditions. Should a settlement not be reached by that time, I reserve the right to seek higher compensation for the copyright infringement according to (insert country of residence) national and international laws. This will then also include any legal fees. I firmly believe that this is a fair offer that benefits both parties." Whether you choose to use a letter like this really depends on what your ultimate aim is. Chances are you won't make any money from the person using the image, but it certainly should act as a deterrent to them using the image, and cause them to take it offline.
