Overgaard Posted January 16, 2007 Share #2 Posted January 16, 2007 Ha ha - my first visit to the forum for 3-4 weeks. And the first picture that meets my eye is a naked woman. I had to check some of the other posts to see if things had changed THAT much since my last visit. Not. It's daring. I think it's a great shot both technically and the expression. It even has some humor to it. I actually find it a very decent and aesthetic picture considering what's going on. That it is so well lit and bright might have added some serenity to it that such pictures usually lack. The angle by the way adds some action that was not there. It is quite embarrassing that in the year 2007 we feel the need to preface this image with a single word to "warn" viewers of what "lurks" behind a photographic link that contains nothing sinister or illegal. This is not child pornography or anything that promotes sex as a power play or extension of mental illness. This is an image honoring the natural state of the human body. What is next? And the second reaction went on the fact she was naked, and touching herself. I think beauty of the lady-model makes this image decent. And I would like to see more pictures of her, please, but with some pretty feminine lingerie or clothes on. I am trying to imagine her reading this thread, and thinking: "Am I that ugly?" The laws in the US regarding sexual harassment have evolved over the last two decades as a result of gross to minor misconduct in the workplace (an example of gross misconduct would be your manager insisting on sexual favors from you for you to either keep your job or get a promotion). Over time sexual harassment laws expanded to lesser offences and now if one of your colleagues sees an image like this on your screen, the colleague might perceive it as sexual harassment and make a complaint to management. Management must investigate the claim, make note of the results and take appropriate action. That action might be anywhere on the continuum of punishing the claimant if the complaint is proven to be false, to firing the offender if the offence is serious and proven to be true. So regardless of whether we feel the “nudity” label is ultimately fair or not, it serves a very practical purpose in the US, and I’m nearly certain that it serves the same purpose in Canada. On another note, think about it: Does the label prevent the image from being placed on the Forum? Does the label prevent you from looking at the image, at least when you are in private? abrewer Posted January 20, 2007 Share #19 Posted January 20, 2007 In defense of moderation (both temperance and editorial) I've had about equally as many e-mails and PM's pro and con on this image and its appropriateness for the Forum. It never offended me from the beginning and when I opened it first time on Wednesday it satisfied my personal comfort level without any problem whatsoever. However, the point that remains unacknowledged in assaying my personal taste is that we are an International Forum, touching a variety of cultures both more and less tolerant in this regard. There's also a legal issue aside from the workplace concerns mentioned by Stuart. In the United States it is a felony offense punishable by fines, as much as ten years federal imprisonment and mandatory registration as a "sex offender", to place pornographic images at a site on the internet viewable by persons less than ten years of age. Needless to say when I learned that the hair on the back of my neck rose. As a moderator squarely located in the heart of America, it makes one think a bit. Yes, there is a difference between what passes fair in Germany and what is tolerated in this country. In the same way I don't understand completely the German aversion to Scientology's creed (absent the goofy alien propositions), I'm sure many of my colleagues there do not understand why these prudish Americans can't "get over it!" It's the law, and for better or worse, vive la difference. One member has suggested to me that these kinds of images belong behind a password and an age-disclaimer. I've forwarded that suggestion to Admin for his consideration. Given the strident nature of the calls by many here for and end to "Censorship", and who've sought to polarize the issue by posting blatantly pornographic images or provoked other members with their taunts, I'm not so sure that we shouldn't do exactly that: hide all the images behind a locked door and completely sanitize the public forum in every respect visually.
