Rules of the Leica Forum Classifieds Section
§1 Preface
These terms and conditions apply for the use of services in the Leica Camera Forum, especially publishing and using the Leica Forum classified section.
This service is provided by Andreas Jürgensen, Fa. juergensen.net (called here "licensee" .
§ 2 Use of the Leica Forum Classifieds
1. The Leica Forum enables its registered members to publish ads under the following terms and conditions:
- no content that is against the law or violates any property rights, for example brands, patents, copyright or any personal rights of other people.
- no content harmful to minors, especially pornographic content
2. The licensee of the forum and its classifieds section is obliged by German law to eliminate unlawful content published by users in the forum or classifieds section. Therefore the licensee reserves the right to delete content from the forum and the classifieds at anytime and without giving reasons.
§ 3 Advertising
1. Ads may be published as described here. It's also possible to subscribe to another user group that may publish a limited number of ads for a fixed price. Subscriptions prolong automatically after running out.
§ 4 Content of Ads
1. The classifieds section is open for private use as well as for commercial ads. Ads are private, if they are published occasional but not on a regulary basis.
To commercial ads special rates apply, please ask the licensee for details. Defined as commercial use is especially: Continuous acquisition, repair and resale of products.
2. In each ad only one product may be offered. It is especially prohibited to offer serveral products with single prices. This rule does not apply to accessories.
3. It is prohibited to offer products, if offering, selling or acquiring of these products are against German law or immorally or violate the reputation of the Leica Forum or its licensee.
4. The forum's licensee reserves the right to shorten ads or to move them to another section. He also reserves the right to ban ads, to delete them or to ban the publisher if there are important reasons, especially if the content of the ad violates German law or is in other ways unacceptable for the licensee.
5. Users of the services offered by the forum have to pay the licensee all costs, he has to pay if because of third party claims caused by ads violating the terms in § 3 and § 4. The customer is also obliged to reimburse costs incurred in asserting our legal rights.
6. External websites may not be linked in ads, URLs may not be published in any other way.
§5 Pricing
1. Pricing for an ad depends on the current price list.
§6 Warranty
1. The licensee is not party in any contract based on an ad in the Leica Forum. The licensee gives no warranty for the products offered.
2. Additionally the licensee issues no warranty
- for the correctness, up-to-dateness of the description or if they are legally allowed
- for the identity, seriousness, behavior, capability or motivation of all parties involved in a contract.
3. Actions of the licensee against single users based on abuse of any service are only taken in own legal and commercial interest. Hereby no claims for any single user derive.
§7 Liability
1. The licensee is not liable for any loss or damage caused by any user of the services.
2. The licensee gives no guarantee for the continuous availability of the website and the technical systems. The licensee has no accountability for any loss or damage caused by use of the services.
3. The licensee is liable in case of slight negligence only if he violated essential contractual obligations. The liability is limited to loss or damage inherent to such contract.
4. The purchaser is responsible for content and legal legitimacy of text and images provided for the advertisement. He indemnifies the licensee from all third party claims related to the advertisement.
§8 Privacy Protection
1. Personal data collected using the website's services are processed in accordance with German data protection regulations.
§9 Place of Fulfilment , Law Applicable
1. Place of fulfilment for all all rights and liabilities deriving from the contractual relationship is Bonn, Germany.
2. The jurisdiction relating to the forum is German law, since the server is operated in Germany and the licensee is resident in Germany. |
